Responsabilidad del outsorcing contable con sus clientes, por presentación indebida de la información exógena nacional

Abstract

En este trabajo se dará a conocer las responsabilidades que podría tener el outsourcing contable, por haber presentado de forma incorrecta o extemporánea la información exógena nacional. Uno de los propósitos con mayor relevancia dentro de este trabajo de grado, es dar a conocer a todas las partes implicadas, es decir el Outsourcing Contable y su cliente, las responsabilidades que podría asumir este, por la presentación inadecuada o fuera de los tiempos de vencimiento de la exógena nacional. Además, se resaltará la importancia de realizar de forma correcta la preparación, elaboración y presentación de esta información, debido a que en algunas ocasiones se puede desconocer el alcance o la responsabilidad que recae sobre los Outsourcing al cometer errores en la presentación del deber formal ya mencionado. Esto en razón a que, en algunos momentos, se cree o se tiene una imagen tal vez errada, que, como la Dian, los terceros mal reportados u otros, requieren directamente al cliente, quien es el directo responsable de asumir monetariamente las correcciones o sanciones al que haya lugar, el outsourcing no tiene responsabilidad alguna con referencia a lo mencionado. Por lo cual, con este trabajo se pretende comunicar la obligación contractual que toma el outsourcing al celebrar un contrato con el cliente. En conclusión, se pretende 1. Prever y dar algunas recomendaciones a los Outsourcing Contables y sus empleados, para que se elabore de forma correcta y se presente en los tiempos establecidos, la información exógena nacional y 2. Que los clientes de estos Outsourcing Contables conozcan cuáles son las medidas que pueden tomar frente a un requerimiento, bien sea por parte de la DIAN, de sus clientes, de sus proveedores o cualquier otro vinculado con su operación, por reportar datos inexactos, no reales o extemporáneos.

In this work we will show the responsibilities that could have the accounting outsourcing, for having presented incorrectly or extemporaneously the national exogenous information. One of the most relevant purposes of this degree work is to inform all the parties involved, i.e. the Accounting Outsourcing and its client, the responsibilities that could be assumed by the latter, for the inadequate or untimely presentation of the national exogenous information. In addition, the importance of the correct preparation, elaboration and presentation of this information will be highlighted, due to the fact that sometimes the scope or the responsibility that falls on the Outsourcing when making mistakes in the presentation of the aforementioned formal duty may be unknown. This is due to the fact that, in some moments, it is believed or there is an erroneous image that, as the Dian, the misreported third parties or others, require directly to the client, who is the direct responsible of assuming the monetary corrections or sanctions, the outsourcing has no responsibility whatsoever with reference to the above mentioned. Therefore, the purpose of this work is to communicate the contractual obligation that the outsourcing company takes when entering into a contract with the client. In conclusion, it is intended 1. To foresee and give some recommendations to the Accounting Outsourcing and their employees, so that the national exogenous information is prepared correctly and submitted in the established times, and 2. That the clients of these Accounting Outsourcing know what measures they can take in case of a requirement, either by the DIAN, their clients, their suppliers or any other related to their operation, for reporting inaccurate, not real or untimely data.
