dc.description.abstractEl presente documento se enfoca en analizar los efectos que se derivaron en la aplicación de la territorialidad antes y después de la Ley 1819 del año 2016 para la empresa Transportes Expresos MCM S.A.S. (Razón social propuesta para proteger la integridad de la información sensible a tratar) Al mismo tiempo, se comentarón las distintas posiciones respecto a la territorialidad, las cuales correspondían al lugar donde se encontraba la sede de negocios o establecimiento; otra en donde se generaba el ingreso; y finalmente otra en el lugar donde se pactaba el contrato, esto conllevaba a que la obligación formal y sustancial solo quedaba en la mayoría de los casos en el municipio donde se tenía la sede, y los demás municipios dejaban de recaudar este tributo, ocasionando una afectación para las secretarias de hacienda. Con la aplicación del la Ley 1819 del año 2016, en su Capitulo II Impuesto de Industria y Comercio artículo 343, que definió el concepto de la territorialidad, el contribuyente se encontró obligado a declarar sus ingresos desde los sitios o lugares desde donde realiza los despachos de la mercancía, lo que generó una mayor tributación en municipios donde no declaraba antes. En este sentido, se originó que el contribuyente se viera afectado en su flujo de caja y su proceso administrativo, por el aumento de la carga tributaria municipal en los municipios donde normalmente no tributaba exponiéndose a sanciones fiscales y económicas.es
dc.description.abstractThis document focuses on analyzing the effects derived from the application of territoriality before and after the Law 1819 of 2016 for the company “Transportes Expresos MCM S.A.S.” At the same time, is related with the different positions regarding to territoriality that were commented, which correspond to the place where the business headquarters or establishment are located; another where the income was generated; and finally ,another in the place where the contract was agreed, which implied that the formal and substantial obligation only remained in most cases in the municipality where the headquarters were had, and the other municipalities stopped collecting this tax, causing an affectation for the secretaries of finance. With the application of the article 343 of Law 1819 of 2016 which defined the concept of territoriality, the taxpayer found himself obliged to declare his income from the sites or places from where he dispatches of merchandise which generated a higher taxation in municipalities where he didn’t declare before. In this sense, the taxpayer was affected in his cash flow and his administrative process due to the increase of the municipal tax burden in the municipalities where he normally didn’t pay taxes, exposing himself to fiscal and economic sanctions.en
