Efectos de la representacion legal respecto al impuesto de IVA en Colombia

Abstract

El presente ensayo se desarrolla con el fin de dar a conocer los efectos que tiene la representación legal en Colombia frente a la responsabilidad del impuesto a las ventas (IVA) cuando se actúa como agente recaudador, el objetivo es mostrar la realidad de asumir la responsabilidad de ser representante legal en una sociedad que es responsable del impuesto a las ventas, sus implicaciones y las consecuencias tributarias, civiles y en muchas ocasiones penales que se derivan de esta obligación sustancial. Esta investigación se apoya en todo el articulado normativo del impuesto a las ventas, la experiencia profesional y académica de sus autores y los eventos que a diario se ven en el medio empresarial, lo que lleva a concluir que las personas que ejecutan éste cargo, les resulta poco útil comprender las dimensiones de dicha figura legal, de la misma forma se resalta las principales consecuencias de asumir la representación legal teniendo en cuenta la solidaridad y subsidiariedad que ello implica.

This essay is developed with the purpose of making known the effects that legal representation in Colombia has on the liability of the sales tax (VAT) when acting as a collection agent, the objective is to show the reality of assuming the responsibility of being a legal representative in a company that is responsible for sales tax, its implications and the tax, civil and often criminal consequences arising from this substantial obligation. This research is based on all the normative articles of the sales tax, the professional and academic experience of its authors and the events that are seen daily in the business environment, which leads to the conclusion that the people who execute this position, it is not very useful to understand the dimensions of this legal figure, in the same way it highlights the main consequences of assuming the legal representation taking into account the solidarity and subsidiarity that this implies.
