dc.description.abstractEste documento se enfoca en el análisis del tratamiento tributario en el impuesto sobre la renta y complementarios para el Leasing habitacional a partir de la incorporación del marco técnico normativo contable vigente en Colombia, -esto es Normas Internacionales de Información Financiera-, como criterio de reconocimiento y medición de los valores de activos, pasivos, patrimonio, ingresos, costos y gastos para la determinación del impuesto sobre la renta y complementarios mediante el artículo 22 de la Ley 1819 de 2016, que adiciona al Estatuto Tributario el artículo 21-1, sin perjuicio de la independencia y autonomía de la normatividad fiscal frente a la normatividad contable y de información financiera establecida en el artículo 4 de la Ley 1314 de 2009. Este ensayo es desarrollado mediante el análisis, selección y compilación de normatividad e información reciente relacionada. Se puede concluir que debido a la convergencia hacia estándares internacionales de contabilidad se dio un cambio determinante en el tratamiento fiscal de la figura de Leasing habitacional que genera el desconocimiento de deducciones por pago de cánones, y el consecuente aumento en la renta líquida del contribuyente usuario de esta opción de financiamiento. Adicionalmente, se concluye que las diferencias de tratamiento bajo la Norma Internacional de Información Financiera 16 – Arrendamientos y lo establecido en el artículo 127-1 del Estatuto Tributario pueden generar diferencias temporarias que dan lugar a la determinación de activos o pasivos por impuesto diferido.es
dc.description.abstractThis document focuses on the analysis of the tax treatment in income and complementary taxes for residential lease based on the incorporation of the technical regulatory accounting framework in force in Colombia, -International Financial Reporting Standards-, as a recognition criterion and measurement of the values of assets, liabilities, equity, income, costs and expenses for the determination of income tax and complementary through article 22 of Law 1819 of 2016, which adds article 21-1 to the Tax Statute, without prejudice to the independence and autonomy of tax regulations compared to the accounting and financial information regulations established in article 4 of Law 1314 of 2009. This test is developed through the analysis, selection and compilation of regulations and recent related information. It can be concluded that due to the convergence towards international accounting standards, there was a decisive change in the tax treatment of the figure of residential lease that generates the ignorance of deductions for payment of royalties, and the consequent increase in the net income of the user taxpayer of this financing option. Additionally, it is concluded that the differences in treatment under the International Financial Reporting Standard 16 - Leases and the provisions of article 127-1 of the Tax Statute may generate temporary differences that give rise to the determination of deferred tax assets or liabilities.
